By using or installing this font data, you (or you on behalf of your employer) agree to be bound by the terms of this Agreement. This Agreement constitutes the complete agreement between you and Nick's Fonts.
Number of Users: In consideration for the license fee paid, Nick's Fonts grants to you only, the Licensee, the non-exclusive, nontransferable right to use and display the font data. If you are using this product for your work, this agreement applies to your employer. Nick's Fonts may be used on up to five (5) CPUs at your site connected to any number of printers or other image-producing devices (regardless of resolutions) at your own site. You may make one (1) copy of the Nick's Fonts font data solely for backup purposes provided the copyright and trademark notices are reproduced in their entirety on the backup copy.
Service Bureaus: You may send a copy of any Nick's Fonts font data along with your documents to a commercial printer or other service bureau to enable the editing or printing of your document, provided that such party agrees to delete the font or fonts from his/her/their system upon completion of your project.
Portable Documents and Web Fonts. You may use this font data
a) to create Portable Font Resources (PFRs) with Bitstream's TrueDoc®, for the purpose of allowing any third party to view, edit or print your documents remotely;
b) to create PFRs with Bitstream's Web Font Wizard® for use on your personal or corporate website;
c) to create Embedded OpenType (EOT) with Microsoft's WEFT for use on your personal or corporate website;
d) to create Scalable Inman Flash Replacement (sIFR) data files for use on your personal or corporate website; and
e) to embed fonts within PostScript files or PDF files for distribution, viewing, and imaging to or by third parties.
Restrictions. You may not modify this font data with intent to resell or redistribute such data without Nick's Fonts's prior written consent. Additionally, you may not adapt, translate, reverse engineer, decompile, disassemble or create derivative works based on the Nick's Fonts font data without Nick's Fonts's prior written consent; you may, however, make modifications if said modifications are intended solely for your personal use or for use within your company, if your company has purchased this license. You may not sell PFRs, sIFRs or EOTs created with this font data to a third party.
Copyright. The Nick's Fonts font data is copyrighted; unauthorized copying of Nick's Fonts is expressly forbidden. You may be held legally responsible for any infringement of Nick's Fonts's intellectual property rights that is caused or encouraged by your failure to abide by the terms of this Agreement. Additionally, Nick's Fonts reserves all rights not specifically granted to Licensee.
Termination. This Agreement will immediately and automatically terminate without notice if you fail to comply with any term or condition of this Agreement. If this Agreement is terminated, you agree to destroy all copies of the font data in your possession.
Disclaimer and Limited Warranty. For a period of 90 days after delivery, Nick's Fonts warrants that the font data will perform in accordance with the specifications published by Nick's Fonts. NICK'S FONTS MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED. THE WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE AND MERCHANTABILITY ARE SPECIFICALLY EXCLUDED. NICK'S FONTS DOES NOT WARRANT THAT THE FONT DATA IS FREE FROM ALL ERRORS AND OMISSIONS. This warranty gives you specific legal rights. You may have other rights, which vary from state to state. NICK'S FONTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FROM LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE NICK'S FONTS FONT DATA. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, this limitation may not apply to you.
Governing Law. This agreement is governed by the laws of the United States of America and the State of Maryland. |
