ActiveSphere Type Foundry
End User License Agreement
By using or installing ActiveSphere Font software you agree to the following terms and conditions of the Agreement:
This is a contract between you and ActiveSphere. This is not a contract for sale of the font software, but a license to use the font software subject to the terms and conditions of the Agreement.
The terms and conditions recited herein apply to your employer as well as to you as a representative of your employer or personally. Third parties are subject to different terms and conditions.
Please read all of the Agreement before you agree to be bound by its terms and conditions.
Number of Users: The ActiveSphere Font Software is licensed for use at a maximum of five (5) Workstations or computers and one (1) printer at one (1) single geographical location stipulated by the licensee.
Multiple Workstations: If you have paid for a Multi-Workstation License Agreement, then you may use the Font Software Product on the number of computers (CPUs) stated on the receipt.
If you need to install the Font Software on more than five (5) computers or install it on more than one output device, you are required to purchase additional Multi-Workstation licenses.
Portable computers may be included within the number of permitted Licensed Computers provided that such portable computers are primarily used at the Licensed Location.
Third Parties: You may send a copy of any Font Software along with your documents to a commercial printer or other service bureau to enable the editing or printing of your document; provided that the commercial printer or service bureau has a valid license to use the Font Software.
Embedding Restrictions: The electronic or digital documents are distributed in a secure format. This allows only the printing and viewing, and prohibits the editing, selecting, enhancing or modifying the text.
Embedding is allowed in Portable Documents files (PDF), PostScript-Language files, and EVY files for viewing, and imaging to other parties.
No recipient is allowed to distribute, duplicate or make additional copies of the PDF.
Embedding to websites is NOT allowed; only static images of the fonts can be used.
Restrictions on Use
You may not modify, adapt, translate, merge, convert formats, reverse engineer, decompile, disassemble, alter or create derivative works of the font software,
You may not distribute or disseminate copies of the Font Software, or electronically transfer the Font Software from one computer to another or over a network. You may not sell, rent, lease, or sublicense the Font Software.
You may make one (1) single copy of the Font Software solely for backup purposes. Copies reproduced for purposes aside form the above mentioned shall be considered illegal and therefore prohibited and is subject to termination of the contract.
Your license for the Font Software is non-returnable and non-refundable.
The Font Software may be returned or exchanged only if defective. Defective software will be replaced when accompanied by a valid sales receipt and ActiveSphere is notified within one (1) week of purchase.
ActiveSphere may terminate your license upon notice of failure to comply with any of the terms of this License. Upon termination, you must immediately destroy the original and any, or all, copies of the Font Software.
ACTIVESPHERE MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED AS TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR OTHERWISE. WITHOUT LIMITING THE FOREGOING, ACTIVESPHERE SHALL IN NO EVENT BE LIABLE TO THE LICENSED USER OR ANY OTHER THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING DAMAGES FROM LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, ARISING OUT OF THE USE OR INABILITY TO USE THE PRODUCT EVEN IF NOTIFIED IN ADVANCE. UNDER NO CIRCUMSTANCES SHALL ACTIVESPHERES LIABILITY EXCEED THE REPLACEMENT COST OF THE SOFTWARE.
YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT.
