Blanco Letters End User Licence Agreement
This End User Licence Agreement (hereinafter ÒAgreementÓ) is a legal agreement between you, or, if you represent a legal entity, that legal entity (hereinafter ÒYouÓ) and Juan Luis Blanco Aristondo -Blanco Letters, Mari kalea, 2. 20750 Zumaia. Spain (hereinafter ÒBLÓ).
By downloading or installing the Font Software You agree on all the terms specified within this Agreement. You also agree to inform any other person having access to the Font and copies thereof, of the terms and conditions of this Agreement and to ensure that they shall strictly abide to these terms and conditions. If you do not agree to the terms and conditions of this Agreement, do not download, install or use the Font Software.
1. Definitions
1.1. ÒComputerÓ: any electronic device in which the Font may be installed. This includes, but is not limited to, desktop computers, laptops, netbooks, tablet PCs, workstationsÉ This does not include servers.
1.2. ÒFont SoftwareÓ (hereinafter ÒFontÓ): means coded software that generates typeface designs when used with the appropriate hardware and software, plus any and all other data including provided with such software.
1.3 ÒDesktop fontÓ: means Font Software that is to be used in Desktop Publishing applications or other software that will render the Font in any way other than a website. BL provides this Fonts in .otf format. If you need them in a different format, please contact BL at juan@blancoletters.com
1.4 ÒWeb fontÓ: means Fonts that are only and exclusively to be used for displaying text in a website. BL provides this Fonts in EOT (Embedded Open Type) and WOFF (Web Open Font Format) formats.
2. Grant of Licence and Restrictions
2.1 Licence. The use of the Font is licensed for one person or entity (You). You are not allowed to rent, sell, lend, lease, sublicense, share or give away the font software to another person or entity. Each separate entity needs to purchase its own licence. You are required to purchase the appropriate licence (see clauses 2.2 and 2.3) according to your needs.
2.2 Desktop font licence. By this licence BL grants You a non-exclusive, non-transferable right to use the Font in as many Computers as declared on purchase. If You need to install the font in more Computers than declared on purchase, You should request from BL or any authorized distributor a licence upgrade. You are not allowed to use Desktop Fonts purchased under this licence in websites unless they are rasterized (PNG, JPG, GIF). You need a Web Font licence to use the Font through the @font-face selector.
2.3 Web font licence. By this licence BL grants You a non-exclusive, non-transferable right to use the Font in one domain. The licence is limited to the amount of page views per month specified on purchase. If the traffic of the domain exceeds the licensed amount of page views you need to extend your licence to cover all page views. You are not allowed to use the Font in ways that give third parties access to the font software
2.4 Embedding. You are allowed to embed your Desktop Font in digital documents as long as such document is distributed in a secure mode that permit only the viewing and printing but not the editing of the text. The document may display the Font either as a rasterized image (e.g. GIF or JPEG) or as a subset of the Font Software. Whatever the format of such digital document, extraction of the Font should be prevented by all appropriate means. For any other embedding mode allowing editing of the text or that is not mentioned in this Clause, you should contact BL or any authorized distributor for an additional licence. You also need an additional licence to embed the font in electronic books, magazines, templates for commercial editions, etc.
2.5 Printing. You may temporarily provide a copy of the Font used in a particular document to a commercial printer or service bureau for the exclusive purpose of printing/outputting such document only if they abide to the terms of this Agreement and retain no copies of the font on completion of the work. In the event of the use of the Font for any other purposes, the printer or service bureau should purchase its own Font licence.
2.6 Modifications. You are not authorized to modify, adapt, reverse engineer, decompile, disassemble, alter, make derivative works or extend the Font adding weight, width or slope variations. You are not allowed to convert the font to a format different from which you purchased. If you require the font in a different format you need to purchase a new licence accordingly with your needs.
2.7 Backup. You are allowed to make backup copies of the font for archival purposes only provided that you retain exclusive control over such copies.
3. Ownership & Copyright
Under this Agreement, you do not gain the ownership of the Font or any part hereof. You agree that the Font software and documentation is the intelectual property of BL, that owns the rights for distribution and reserves all rights to intellectual property. You acknowledge that the Font and the documentation is protected by the laws of Spain, by the copyright and design laws of other nations and by other treaties.
4 Warranty and Limitation of Liability
BL warrants that the font software will perform in accordance with the documentation provided. Damaged or defective font software can be replaced when accompanied by the valid sales receipt within 30 day period after purchasing. Note that not all systems or applications support OpenType features and kerning equally well. Please check whether the system or application you intend to use the Font in supports them, since no refund or replacement will be offered by BL in case the defective performance is due to other software support problems.
THE FONT SOFTWARE IS PROVIDED ÒAS ISÓ, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF COPYRIGHT, PATENT, TRADEMARK, OR OTHER RIGHT. IN NO EVENT SHALL BL BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, INCLUDING ANY GENERAL, SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF THE USE OR INABILITY TO USE THE FONT SOFTWARE OR FROM OTHER DEALINGS IN THE FONT SOFTWARE.
5. Termination
The licence is effective as of the date of full payment for the purchased licence until terminated. BL has the right to terminate your licence if You fail to comply with any terms and conditions of this agreement. BL reserves the right to claim punitive damages. Upon termination, you must destroy the original and any copies of the font software and documentation.
